Why use service of process by publication

Even the most diligent efforts to locate a defendant to serve legal documents to them can be unsuccessful. In this instance, the court may allow you to notify of the legal case against the defendant by publishing legal documents in a newspaper. The newspaper is typically required to be “general circulation,” which is defined as a publication that is made accessible to the public to provide news and information, published daily or weekly, sold to subscribers for a cost, and has a second class mailing permit from the United States Postal Service (USPS). The publication should also have a minimum of four pages and at least four columns to be considered general circulation.

Typically, this is a daily or weekly newspaper in a city, town or region. Or, it can be a qualified online outlet. An ad is purchased and published notifying the defendant of the legal case against them, including summons, subpoenas, or other legal documents. Judges typically mandate that the ad is published weekly for several weeks to meet the requirements of service by publication. You will likely need to show the judge in your case that you have served by publication once your ad is published.

The court usually does not consider free newspapers or publications suitable for service by publication. All credit card transactions will carry an extra three percent (3%) fee to cover bank credit card processing fees.
