What Is International Service of Process?

Service of process is how a court makes sure a defendant knows about a lawsuit before a judgment is entered. Abroad, that delivery must follow the destination country’s rules and often a treaty with the United States. Mailing a summons overseas usually does not count.

Getting it wrong is costly. Under the Hague Service Convention, a court generally cannot enter a default judgment unless the documents were served by an approved method or actually delivered in time. Defective service means delays, re-service, and judgments that are harder to enforce.

How Does the Hague Service Convention Work?

The Hague Service Convention (1965) is the treaty behind most international service of process. More than 80 countries are members. It works in four steps:

  1. Each member designates a Central Authority to receive service requests.
  2. We send the request form and translated documents to that authority.
  3. The authority arranges service under local law.
  4. It returns a certificate showing when, where and how service happened. That is your proof of service.

The Convention does not apply to non-member countries, unknown addresses, or non-civil and non-commercial matters.
